1. About Us
1.1 The website www.electricsporran.com (“the site”) is run by Electric Sporran Ltd (“Electric Sporran”, “we”, “us” and “our”).
1.2 We are registered in Scotland under company number SC886423, and our registered office is at Office 397, Unit LGE, 18 Young Street, Edinburgh, EH2 4JB.
2. These Terms
2.1 Thank you for visiting our site. These terms set out how you may use it. By using the site, you accept them. If you don’t agree to them, please don’t use the site.
2.2 Our Acceptable Use Policy and our Privacy Policy also apply to your use of the site.
2.3 These terms cover the site only. Our games and apps are sold and licensed through the stores you get them from, under those stores’ terms and any licence shown with the game or app.
3. Using Our Site
3.1 The site is free to use. We may change, suspend or withdraw all or part of it at any time, and we can’t promise that it will always be available or free of errors.
3.2 You are responsible for making your own arrangements to reach the site, and for making sure that anyone who uses it through your internet connection knows about these terms.
4. Our Content
4.1 We own, or are licensed to use, all the intellectual property in the site and in what is published on it, including its words, pictures, artwork, logos and games material. All rights are reserved.
4.2 You may view and print pages for your own personal use, and you may share links to the site and draw other people’s attention to what is on it.
4.3 Journalists, streamers and content creators are welcome to use screenshots, artwork and press material from the site when writing about or featuring our games, as long as Electric Sporran is credited. For any other use, please contact us first.
4.4 You must not use material from the site for any other commercial purpose, or present it as your own, without a licence from us.
4.5 “Electric Sporran”, our logos and the names of our games may be trade marks, and must not be used in a way that suggests a connection with us where there is none.
5. What You Send Us
5.1 When you send us feedback or ideas, for example about our games, you keep any rights you have in them. Because we may already be working on similar ideas, or have them in the future, you agree that we may use any feedback or suggestions you send us freely, without owing you anything for it.
5.2 This doesn’t apply to the details of a project you share with us in a design services enquiry, which we keep confidential and use only to discuss and provide the work you ask about.
5.3 What you send us must meet our Acceptable Use Policy.
6. Information on Our Site
6.1 The worlds, stories and characters of our games are fiction. Any resemblance to real people, living or dead, or to real places or businesses, is coincidental.
6.2 What we say about games in development, including features and release dates, describes our plans at the time and may change.
6.3 The content of the site is for general information only. It is not advice that you should rely on, and some of it may be out of date at any given time.
7. Our Liability
7.1 Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that the law does not allow us to limit or exclude.
7.2 If you use the site as a consumer, we only provide it for private use. We are not liable to you for any loss of profit, loss of business, business interruption or loss of business opportunity. We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill, but not for loss or damage that was not foreseeable.
7.3 If you use the site in the course of a business, we exclude, as far as the law allows, all implied conditions, warranties and other terms, and we are not liable for any indirect or consequential loss, or for any loss of profit, sales, business, revenue, goodwill or data, arising from your use of the site or your reliance on anything on it.
7.4 We are not responsible for websites we link to. Links are provided for your information only, and we have no control over those websites or what is on them.
8. Viruses and Misuse
8.1 You must not misuse the site by knowingly introducing viruses, trojans, worms, logic bombs or other harmful material. You must not try to gain unauthorised access to the site, the server it is stored on, or any server, computer or database connected to it, and you must not attack the site with a denial-of-service attack or a distributed denial-of-service attack.
8.2 Doing any of these things may be a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and co-operate with them, which may include sharing your identity with them. Your right to use the site will end immediately.
8.3 We take reasonable care to keep the site free of harmful material, but we can’t guarantee it. You should use your own virus protection software.
9. Linking to Our Site
9.1 You are welcome to link to any page of the site, as long as you do so fairly and legally and in a way that doesn’t damage our reputation or take advantage of it. You must not link to us in a way that suggests we approve of or are associated with you where we are not.
9.2 You must not frame the site, or any part of it, on another website.
9.3 We may withdraw permission to link at any time.
10. Changes to These Terms
10.1 We may change these terms from time to time by updating this page, and the date at the top shows when they last changed. Please check back now and then, as the terms in force when you use the site are the ones that apply.
11. The Law That Applies
11.1 These terms are governed by Scots law, and the Scottish courts may hear any dispute about them. If you are a consumer living elsewhere in the UK, you may also bring proceedings in the courts of the part of the UK where you live, and you keep the protection of the consumer laws that apply there.
12. Contact
12.1 If you have a question about these terms, or a concern about anything on the site, please contact us.
